ISSUES PAPER TO IMPROVE NOT-FOR-PROFIT LAW & REGULATION
The aim of this project is to deliver an issues paper that sets out a policy framework that can
serve as a basis for proposals to change national and state law and regulation of the
not-for-profit sector.
This policy framework should have regard to both the economic and community role of
not-for-profit sector organisations and provide an integrated approach for the Government to
consider how best to regulate the sector.
B>1 Introduction
The Victorian Government is committed to strengthening communities through a joined up approach
to planning, funding and delivering services at the local level.
Government recognises the importance of supporting communities to strengthen their capacity to
improve their social, economic and environmental conditions.
Further, it acknowledges that communities are often in the best position to set their own
priorities for the future and that Government has a central role to play in coordinating and
resourcing initiatives to achieve positive influences on community life.
Strong communities are recognised as being active, confident and resilient.
They are communities that have strong social networks, have local leaders with a vision, can
respond to challenges and shape their own future.
These communities are creative and collaborative and encourage the involvement of volunteers.
The Department for Victorian Communities (DVC) has been established to give effect to the
Victorian Government’s objective of strengthening communities.
DVC has a mandate to work across all of Victoria and for all Victorians.
2. Background to the Project
In June 2004 the Minister for Victorian Communities, the Honourable John Thwaites MP, announced
$21M over 3 years to undertake initiatives to develop volunteering and community enterprise as
part of a strategy that aims to support the strengthening and sustainability of the
not-for-profit sector.
To this end, the strategy focuses on encouraging the involvement of business in community issues,
the development of community and social enterprises to support innovation and sustainability and
to foster an enabling environment in the sector.
More recently, in April 2005 the Victorian Government released "A Fairer Victoria" which
announced the development of long term plans to strengthen Victoria’s community organisations by
reforming legislation and regulations covering the not-for-profit sector.
The sector contributes an estimated 5% of GDP, includes over 30,000 organisations and is at the
heart of community participation in volunteering and civil society.
Government recognises that while the importance of the not-for-profit sector has grown
considerably over the last decade, the current web of regulatory arrangements is resulting in
confusion, duplication, inconsistencies across state borders and a substantial regulatory
burden on the sector which is inhibiting voluntary action and innovation.
Two major national inquiries have previously called for reform of the regulation of the
not-for-profit sector, with the Industry Commission Inquiry into Charitable Organisations (1995)
and the Charity Definition Inquiry (2001).
In both cases, no major action was taken by Governments.
In early 2005 the national roundtable of non-profit organisations was established to explore
regulatory reform for the non-profit sector.
The Victorian Government will be undertaking research, analysis and options for reform to
develop a position on ways forward to improve the not-for-profit regulatory environment.
3 Aim of Project
The aim of this project is to deliver an issues paper that sets out a policy framework that
can serve as a basis for proposals to change national and state law and regulation of the
not-for-profit sector.
This policy framework should have regard to both the economic and community role of
not-for-profit sector organisations and provide an integrated approach for the Government to
consider how best to regulate the sector.
The paper should also consider international models, including current approaches in Canada,
UK, New Zealand and the USA, the proposals of the Not-for-Profit Roundtable, together with the
recommendations of the Charity Definition Inquiry (2001) and the Industry Commission report on
community sector welfare organisations, (1995).
4 SCOPE OF THE WORK
4.1 Key Tasks (Terms of reference)
The position paper is to include analysis of:
4.1.1 Objectives of Government regulation of the not-for-profit sector.
Prepare a discussion of the objectives of Government regulation of the not-for-profit
sector, how these objectives may differ from regulation of for-profit bodies, the range
of regulatory approaches Government may adopt towards the sector and some key design
principles of an effective and efficient regulatory framework, taking account of both
its economic and social contribution.
4.1.2 Current regulatory institutions.
Review and analyse the range of organisations that currently regulate Victorian
not-for-profit organisations, including an assessment of, and the extent to which:
1 These organisations conform with key design principles as identified under point
4.1.1;
2 Existing public policy objectives are effectively monitored and enforced;
3 Current regulatory arrangements impact on funding agreements between Government
Departments and not-forprofit sector organisations; and
4 Current administrative cooperation between State and Federal regulators and the
capacity to improve.
4.1.3 Options for reform.
Develop proposals for changing current institutions on the basis of the public policy
objectives to be pursued in regulating the not-for-profit sector.
4.1.4 Consequences for State and Commonwealth Governments.
Discuss and analyse the implications for both State and Commonwealth Governments of
implementing the proposed framework, including consequences and policy options related
to:
1 Taxation concessions to Victorian not-for-profit organisations;
2 Regulation of fund-raising;
3 Accounting standard and practice;
4 Models for incorporation;
5 Public reporting and monitoring;
6 Commonwealth and State responsibilities; and
7 Legislation at both Commonwealth and State levels.
It is important that the issues paper present some key principles and major options for change.
The paper should also make broad estimates of the benefits and costs of such proposals and
identify major issues related to the implementation of proposals.
4.2 Deliverables
The deliverables for the Project are:
1 Revised project plan for regulation of the not-for-profit sector;
2 Draft report outlining research, analysis and proposals for reform;
3 Final report including all required components and finalised options for
reform; and
4 Targeted consultation, (ie. Workshops, 2-4) to be coordinated through
DVC in partnership with peak not-for-profit organisations.
5 MILESTONES AND TIMELINES
The Project includes the following milestones and indicative timelines:

3 Provide draft report on improving the not-for-profit regulatory environment - September
4 Provide the final report and summary - October
6 ASSESSMENT
Proposals will be assessed against the following criteria:
1 Demonstrated professional experience in the area of research and consultancy related
to the not-for-profit sector;
2 Soundness of understanding of the requirements of the project;
3 Appropriateness of proposed approach to undertaking the tasks outlined in this document;
and
4 Cost competitiveness and value for money.
Proposals should include the following information:
1 Names and details of relevant skills and experience of designated person/s undertaking
the tasks;
2 Methodology and tools to be used;
3 Budget addressing all aspects of the Project proposal including the costs associated
with each key task of the Project;
