THE ROLE OF AN ELECTRONIC NOTARY
Purpose This is an outline of a proposed Electronic Notary process for e-mail. This Electronic Notary process has evolved from experiences with direct marketing in the 1970s and 1980s and e-mail marketing since 1980. This outline process is put forwarded to the Treasury department E-commerce Panel of Experts for consideration. The concept of the Electronic Notary as a Value Added Network Service [VANS] was developed by Halisa in Oct 1988 for the Australian Insurance Industry The acceptance of this concept was confirmed by the Legal Workshop 12:00-12:30 at the TEDIS EDI Conference in Brussels in Jun 1989 It is supported by reference to the article "E-mail: the final frontier" Australian 23/11/1999 and the requirement for "a terser way of communicating by e-mail". It is envisaged that there will be a number of work groups required to finalise the message types for each industry group. The planning to support this "terser way of communicating by e-mail" has to be carried out now. This is to enable e-mail software developers to include these more "terse ways of communicating" in E-commerce and e-mail software before e-mail becomes too prevalent as a business communications tool and congests the Internet even further to unacceptable levels of response. The process for an Electronic Notary for E-commerce transactions is different. Electronic Notary for e-mail There are Standard messages to a subscribe to receive e-mail on a distribution lists b unsubscribe from a distribution lists c unsubscribe from an unsolicited distribution list d confirm registration for distribution list e confirm de-registration from distribution list f acknowledge de-registration from distribution list Each standard message is given a code so that only a code is sent not the message There are Standard fields for e-mail addresses 1 Personnel e-mail address 2 Departmental e-mail address 3 Corporate e-mail address Examples Sender Organisation E-mail message types a Any organisation that wishes to distribution information by e-mail has to register with its Association that it will be distributing certain types of information by e-mail eg: 1 Notices of Events 2 Product updates 3 Project Information 4 Marketing information 5 Medical records 6 Complaint registration b The contacts details and physical address of the ISP Subscribing to Distribution Lists a a standard message is sent to the organisation. A copy is posted to the Electronic Notary b A confirmation registration message is sent from the organisation. A copy is registered at the Electronic Notary Electronic Notary for Distribution Lists c The name of the person who registered is recorded d The e-mail address of the person who registered is recorded e The organisation that has been subscribed to is recorded Reasons to record registrations histories a Assist identify e-mails that congest systems b enable research to assist reduce congestion c assist identify distributors that may require assistance to streamline distribution documents particularly if include graphics, moving picture, voice etc Un-subscribing from Distribution Lists a a standard message is sent to the organisation. A copy is registered at the Electronic Notary Role of Electronic Notary with Distribution Lists The information recorded by the Electronic Notary includes: c The name of the person who de-registered d The e-mail address of the person who de-registered e The organisation that has been un-subscribed f a code that confirmation of de-registration has been sent by the Consumer g a code to confirm that the de-registration code has been received by the Organisation h a code to confirm that acknowledgment of de-registration has been sent by the Organisation i a code to confirm that the acknowledgment has been received by the Consumer Un-subscribing from unsolicited Distribution Lists a a standard message is sent to the organisation. A copy is posted to the Electronic Notary b A confirmation registration message is sent from the organisation. A copy is registered at the Electronic Notary Electronic Notary for Unsolicited e-mail Distribution Lists The information recorded by the Electronic Notary includes: c The name of the person who de-registered d The e-mail address of the person who de-registered e The organisation that has been un-subscribed f a code that confirmation of de-registration has been sent by the Consumer g a code to confirm that the de-registration code has been received by the Organisation h a code to confirm that acknowledgment of de-registration has been sent by the Organisation i a code to confirm that the acknowledgment has been received by the Consumer Conclusion The key for effective Confidence in E-commerce is for a better way to manage e-mail so that the Consumer has choice without being swamped by unsolicited e-mail while business traders have the Ability to compete in both the national and international market without being hampered by restrictive national guidelines. It provides the opportunity for Australian software developers to work together to provide software which will enable the Consumer and Australian traders to benefit from exports of software.
